HeartGo User Agreement

Welcome to use the "HeartGo" application (hereinafter referred to as "this APP" or "we"). To clarify the rights and obligations between you and us, regulate your use of this APP, and protect your legitimate rights and interests, we hereby formulate this User Agreement(hereinafter referred to as "this Agreement"). Please carefully read and fully understand all terms of this Agreement before downloading, installing, or using this APP, especially the terms regarding our exemption or limitation of liability, data collection and use, and dispute resolution. Once you actually use the services of this APP, it means you have fully read, understood, and accepted all contents of this Agreement and are willing to be bound by this Agreement. If you do not agree to any term of this Agreement, please immediately stop downloading, installing, and using the services of this APP.

1. Service Content and Scope

1.1 This APP is a mobile application that provides heart rate monitoring, data recording, analysis, and other related services. We will update or adjust the service content of this APP according to technological development, market demand, and operational conditions. The specific services shall be subject to those provided by this APP when you actually use it.
1.2 You understand and agree that some services may require you to enable relevant permissions of your mobile phone, such as Bluetooth, location, camera, and storage. You can independently manage the above permissions in the mobile phone settings. If you do not enable the corresponding permissions, you may not be able to use such services normally, but it will not affect your use of other unrelated services of this APP.
1.3 We reserve the right to suspend, interrupt, or terminate part or all of the services within the scope permitted by laws and regulations according to the needs of business development. We will notify you in advance as much as possible within a reasonable scope and handle subsequent matters in accordance with the provisions of relevant laws and regulations.

2. User Rights and Obligations

2.1 User Rights

2.1.1 You have the right to use all services provided by this APP in accordance with the provisions of this Agreement.
2.1.2 You have the right to put forward opinions, suggestions, or complaints regarding the service quality of this APP, and we will promptly handle your feedback.
2.1.3 You have the right to inquire about, correct, or delete your personal information in accordance with the provisions of this Agreement. For specific operation methods, you can refer to the relevant guidelines in this APP or contact us via the customer service email heartgonow@outlook.com.

2.2 User Obligations

2.2.1 When using the services of this APP, you shall comply with national laws and regulations, social ethics, and the provisions of this Agreement, and shall not use this APP to engage in any illegal or irregular activities, including but not limited to:

 Violating laws and regulations in national political, economic, cultural, and other fields; disseminating information that endangers national security, honor, and interests; undermining national unity; inciting ethnic hatred; advocating terrorism, extremism, cults, obscenity, pornography, violence, gambling, and other illegal and irregular information;

 Infringing upon the intellectual property rights, portrait rights, reputation rights, privacy rights, property rights, and other legitimate rights and interests of any third party;

 Forging or tampering with information or data; using this APP service in the name of others; or engaging in fraud, false advertising, and other activities;

 Maliciously attacking or damaging the system security and data security of this APP; or spreading viruses, malicious programs, and the like through this APP;

 Other acts that violate laws and regulations or damage the legitimate rights and interests of us and third parties.
2.2.2 You shall properly keep your mobile device and account information. Any losses caused by the loss, theft of your mobile device, or leakage of your account information due to your own reasons shall be borne by you.
2.2.3 When using the services of this APP, you shall respect the legitimate rights and interests of other users, shall not publish information that insults, slanders, or harasses others, and shall not engage in acts that infringe upon the rights and interests of other users.
2.2.4 You shall comply with the relevant operation rules of this APP. If we update the operation rules, you shall comply with the updated operation rules.

3. Data Collection and Use

3.1 To provide you with high-quality services, we will collect your relevant information with your authorized consent according to service needs, including but not limited to:

 Personal identification information: such as the mobile phone number and email address provided by you during registration;

 Health data information: such as the heart rate data and monitoring time generated when you use the heart rate monitoring function of this APP;

 Device information: such as the model of your mobile phone, operating system version, unique device identifier, network status, and the like;

 Usage behavior information: such as the time you log in to this APP, the service functions you use, operation records, and so on.
3.2 We collect your information only for the following purposes:

 To provide you with the core services of this APP, such as heart rate monitoring, data recording, and analysis;

 To optimize the service quality of this APP and improve the user experience, such as improving the function design according to users' usage habits;

 To ensure service security, identify and prevent risks, and maintain normal service order;

 To push you information or notifications related to services, such as service updates and function optimization prompts (you can independently turn off relevant pushes according to your needs);

 Other legitimate purposes with your authorized consent.
3.3 We will take reasonable and necessary technical measures such as encrypted storage, access control, and security auditing to protect the security of your personal information and health data, and prevent information from being leaked, tampered with, lost, or misused. Unless otherwise stipulated by laws and regulations or with your explicit authorization, we will not disclose your personal information and health data to any third party.
3.4 You understand and agree that to improve the service quality, we may analyze and use the collected anonymized and aggregated data. Such analysis and use will not involve your personal identification information, and we have the right to use the results of such analysis for commercial purposes, such as academic research and industry reports.
3.5 You can withdraw your authorization and consent for information collection at any time through the relevant settings in this APP or by contacting the customer service email heartgonow@outlook.com. However, please note that if you withdraw the relevant authorization, some services may not be used normally.

4. Intellectual Property Rights

4.1 All contents of this APP, including but not limited to software programs, interface designs, text contents, pictures, icons, trademarks, logos, etc., their intellectual property rights belong to us or the relevant right holders. Without the written permission of us or the relevant right holders, you shall not arbitrarily copy, modify, spread, display, distribute, transfer, license others to use, or use them for other commercial purposes.
4.2 The intellectual property rights of the content generated by you during the use of the services of this APP (such as the interpretation of personal health data uploaded by you, usage experience, etc., hereinafter referred to as "User Content") belong to you. However, you agree to grant us a worldwide, non-exclusive, free, transferable, and sub-licensable license to use, copy, modify, display, and spread such User Content in the process of providing the services of this APP. You guarantee that your User Content does not infringe the intellectual property rights or other legitimate rights and interests of any third party. If any dispute arises due to the User Content, you shall bear all responsibilities. If we suffer losses, you shall compensate us.

5. Disclaimer

5.1 The health-related services such as heart rate monitoring provided by this APP are only for daily health reference and do not constitute medical diagnosis, treatment advice, or health certification. You shall not judge your condition or adjust the treatment plan solely based on the data provided by this APP. If you have health problems or doubts, please consult a professional doctor in a timely manner. We shall not be liable for the accuracy, completeness, and medical applicability of the health data provided by this APP. Any losses caused by your reliance on such data shall be borne by you.
5.2 We will make our best efforts to ensure the stable operation of this APP and the normal provision of services. However, due to technical failures, network problems, server maintenance, third-party service interruptions, or other force majeure factors, the services of this APP may be suspended, interrupted, or unable to be used normally, and we shall not be liable for this. You shall understand and accept such service risks.
5.3 We shall not be liable for any losses caused by your violation of the provisions of this Agreement, provision of false information, failure to properly keep account information, improper operation, or infringement by third parties.
5.4 This APP may contain links to third-party websites or services, which are provided only for your convenience. We shall not be liable for the content, security, legality, and service quality of third-party websites or services. The risk of your accessing third-party websites or using third-party services shall be borne by you.

6. Modification and Termination of the Agreement

6.1 We have the right to modify or supplement this Agreement according to the update of laws and regulations, the adjustment of service content, and the needs of operation. The modified Agreement content will be displayed on the settings page of this APP. If you continue to use the services of this APP after the modification of the Agreement, it means you have accepted the modified Agreement. If you do not agree to the modified Agreement, please immediately stop using the services of this APP.
6.2 You can apply to us for account cancellation at any time. After the account is cancelled, this Agreement shall be terminated, and you will no longer be able to use the services of this APP. After the account is cancelled, we will handle your personal information in accordance with the provisions of relevant laws and regulations. Generally, we will delete your personal information or anonymize it, unless otherwise stipulated by laws and regulations.
6.3 If you violate the provisions of this Agreement, we have the right to take measures such as warning, suspending services, freezing the account, and terminating the Agreement according to the severity of the circumstances. Any losses caused thereby shall be borne by you.
6.4 After the termination of this Agreement, the validity of the independent clauses in the Agreement regarding intellectual property protection, disclaimer, and dispute resolution shall not be affected.

7. Dispute Resolution

For any disputes arising from the conclusion, performance, interpretation, and dispute resolution of this Agreement, you and we shall first resolve them through friendly negotiation. If the negotiation fails, either party has the right to file a lawsuit with the people's court with jurisdiction at our location.

8. Others

8.1 The conclusion, entry into force, performance, interpretation, and dispute resolution of this Agreement shall be governed by the relevant official laws and regulations.
8.2 If any clause in this Agreement is determined to be invalid, illegal, or unenforceable, such clause shall not affect the validity of other clauses, and other clauses shall still be valid and binding on both parties.
8.3 If you encounter any problems, have any questions, or suggestions during the use of the services of this APP, you can contact us via the customer service email heartgonow@outlook.com, and we will reply to you within a reasonable time.
8.4 This Agreement shall take effect from the date when you actually use the services of this APP.
